1 Year standard with all equipment.
Kiosk Equipment 1 Year Warranty
Kiosk Equipment 1 Year Warranty:    For a period of 1 year from the date of purchase and delivery, if a product is determined to be defective by FITHCO’s technicians, FITHCO, Inc. will repair or replace the product with refurbished or remanufactured parts or components. This warranty is valid only for the first consumer purchaser only and non-transferable. A FITHCO, Inc. Component is covered by warranty for this period of one year for parts and labor from the date of receipt. The warranty does not cover removal or replacement of the part or on-site visit.  Additional warranties up to 3 years are available and will be noted on the sales agreement.   No warranties, expressed or implied, will apply after the one year warranty unless specified in the sales agreement.

Warranty Details: 
This warranty does not cover cosmetic damage or damage due to acts of God, accident, misuse, abuse, negligence, or modifications of, or to any part of the product. This warranty does not cover damage due to improper operation or maintenance, a connection of improper voltage supply or if any additional component(s), device(s), wiring(s) of any kind are connected to the said equipment, or attempted repair by anyone other than a facility/rep. authorized by FITHCO, Inc. to service the product. This warranty does not cover damage or failure due to external causes such as lightning and power surges, fire, abuse or misuse, operating outside of prescribed environments, and problems arising from the integration of products not supplied by FITHco, Inc.  In addition FITHco, Inc will not be liable in any way for accidental damage, physical damage, damage in transit, theft, software not installed by FITHco, Inc. or operator error arising from the use of their products/software.  MDKS does NOT program software and bears no responsibility for software related issues.
This warranty does not cover irregular pixel performance on the screen display 3 points, and damages due to delivery or improper shipping. This warranty does not cover products sold AS IS or WITH ALL FAULTS, and failure to follow instructions supplied with the product. This warranty is invalid if the FITHco, Inc. factory-applied serial number nameplate has been altered or removed for the product and broken security seal.
The delivered MDKS Kiosk is NOT to be altered or the have the peripherals and/or components added to it without the approval of MDKS.  Failure to heed may result in voiding the warranty.

A.) YOU AGREE THAT WE WILL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) OR FOR ANY INJURY TO OR LOSS OF GOODWILL, REPUTATION, BUSINESS, PRODUCTION, REVENUES, PROFITS, ANTICIPATED PROFITS, CONTRACTS OR OPPORTUNITIES (REGARDLESS OF HOW THESE ARE CLASSIFIED AS DAMAGES), OR FOR ANY EXEMPLARY, SPECIAL, PUNITIVE OR ENHANCED DAMAGES WHETHER ARISING OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, PRODUCT LIABILITY OR OTHERWISE (INCLUDING THE ENTRY INTO, PERFORMANCE, OR BREACH OF THIS AGREEMENT OR THESE TERMS), REGARDLESS OF WHETHER SUCH LOSS OR DAMAGE WAS FORESEEABLE OR THE PARTY SUFFERING THE LOSS OR DAMAGE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE (NOTWITHSTANDING THE FAILURE OF ANY AGREED TO OR OTHER REMEDY OF ITS ESSENTIAL PURPOSE) ARISING FROM, RELATING TO, OR CONNECTED WITH: (1) THE USE OR INABILITY TO USE UNITS PURCHASED BY YOU, (2) THE COST OR REPLACEMENT OF UNITS PURCHASED BY YOU, OR (3) ANY OTHER MATTER ARISING FROM, RELATING TO OR CONNECTED WITH OUR UNITS; OUR SERVICE;THESE TERMS AND/OR THIS AGREEMENT; OR YOUR PURCHASE. AS USED IN THIS AGREEMENT, “INDIRECT DAMAGES” OR “CONSEQUENTIAL DAMAGES” INCLUDES, WITHOUT LIMITATION, LOSS OF REVENUE, PROFIT OR USE OF CAPITAL, PRODUCTION DELAYS, LOSS OF PRODUCT, RESERVOIR LOSS OR DAMAGE, OR LOSSES RESULTING FROM FAILURE TO MEET DEADLINES.   YOU FURTHER WAIVE & RELEASE ANY AND ALL CLAIMS AGAINST US FOR INDIRECT, CONSEQUENTIAL OR PUNITIVE DAMAGES DIRECTLY OR INDIRECTLY ARISING OUT OF THESE TERMS REGARDLESS WHETHER CAUSED OR CONTRIBUTED TO BY THE SOLE, JOINT OR CONCURRENT NEGLIGENCE, STRICT LIABILITY, PREEXISTING CONDITION, OR ANY OTHER FAULT OF US.
B.) WE WILL NOT BE LIABLE FOR ANY FAILURE OR DELAY IN PERFORMING UNDER THESE TERMS WHERE SUCH FAILURE OR DELAY IS DUE TO CAUSES BEYOND OUR REASONABLE CONTROL INCLUDING PRODUCTION DELAYS, NATURAL CATASTROPHES, GOVERNMENTAL ACTS OR OMISSIONS, LAWS OR REGULATIONS, TERRORISM, LABOR STRIKES OR DIFFICULTIES, COMMUNICATIONS SYSTEMS BREAKDOWNS, HARDWARE OR SOFTWARE FAILURES, TRANSPORTATION STOPPAGES OR SLOWDOWNS OR THE INABILITY TO PROCURE NECESSARY SUPPLIES OR MATERIALS AS DETERMINED IN OUR SOLE JUDGMENT OR DISCRETION.
C.) IN NO EVENT WILL OUR AGGREGATE LIABILITY TO YOU OR ANY THIRD PARTY IN ANY MATTER ARISING FROM, RELATING TO OR CONNECTED WITH OUR SERVICE; THE UNITS PURCHASED BY YOU; OR THESE TERMS EXCEED THE SUM OF ONE HUNDRED ($100) DOLLARS.
D.) SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE LIMITATIONS OF THE FOREGOING SECTIONS MAY NOT APPLY TO YOU.
E.) YOU AGREE THAT THE LAWS OF THE STATE OF GEORGIA SHALL APPLY TO THESE TERMS AND/OR AGREEMENT. FURTHER YOU AGREE THAT ANY AND ALL LEGAL PROCEEDINGS OF ANY KIND, WHETHER DEMANDS, LAWSUITS, OR LEGAL ACTIONS, AND WHETHER BROUGHT OR INITIATED BY YOU OR BROUGHT OR INITIATED BY US, SHALL BE FILED, HELD, MAINTAINED, AND/OR CONDUCTED SOLELY IN THE STATE OF GEORGIA, TO THE EXCLUSION OF ALL OTHER JURISDICTIONS IN THE KNOWN WORLD, AND FURTHER YOU AGREE TO AND CONSENT THAT THE VENUE WITH RESPECT TO ANY LEGAL PROCEEDINGS SHALL BE THE SUPERIOR COURT OF WHITE COUNTY GEORGIA AND NO OTHER COURT IN GEORGIA.
F.) YOU AGREE THAT YOU AGREE TO THESE TERMS WHETHER AS PART OF AN ORIGINAL PURCHASE OR WHETHER RECEIVED BY YOU AFTER ORIGINAL PURCHASE.          
                                                                                                                                                                                                               
Proof of Purchase:   Original document in the form of a bill of sales or receipt invoice, which is evidence that the unit is within the warranty period, must be presented to obtain warranty service.

FITHCO, Inc. shall not be liable for the loss of the use of the product, inconvenience, loss or any other damages, direct or consequential, arising out of the use of, inability to use, or any claim against the customer by any other party. Some regions do not allow the exclusion of incidental or consequential damages, so the above limitations and exclusions may not apply to you. Any and all legal proceedings shall be governed by the State of Georgia.

Faulty goods returned will be repaired or replaced depending on the OEM manufacturer’s policies. Where possible, FITHCO, Inc. will replace the faulty goods in a prompt manner. However, some goods cannot be replaced and will be sent back to the OEM manufacturer for repair or replacement under the OEM manufacturer's warranty. If the part is found to be in satisfactory working order, the part will be returned to the customer at the customer’s expense. For your convenience, FITHCO, Inc. has established FAQ for frequently asked questions, or you can contact our technical support.

*  KIOSK Screen/Panel is NOT to be positioned uncovered facing EAST or West with Direct Sunlight on the screen/ panel.  Failure to heed may result in damage to the screen/panel and may void warranty. The inclusion of IR Blocker 90 greatly reduces the possibility of solar damage to the screen but MDKS recommends NOT positioning the screen in direct sunlight.
*  To fully activate the warranty MDKS requires, and politely requests 5x pictures of the INSTALLED KIOSK in its final resting place sent via email to SUPPORT@MDKS.net.  Please include the location address.   Pictures to capture: 1) front   2) rear (if possible)   3) one side   4) inside unit  5) the mounting & electric 
*  Note that our screen displays are assembled and optically bonded per order, and the panels are continually curing.       Any mild ‘halos’ are considered normal and will eventually become unnoticeable.   
*  MDKS recommends that clients utilize colored screen backgrounds, and refrain from using white.
* Kiosks are to be powered-on at all times to maintain Auto-Thermal- Management.  If an outdoor kiosk is powered down, it is MANDATORY to properly protect the unit within a climate controlled environment.  Failure may void warranty.

RMA POLICY:
If there is an RMA request, please print the RMA form located on http://www.FITHCO.net, complete it & return it via fax or email. Once the RMA is authorized, return the product in its entirety together with the authorized RMA form.  ANY UNAUTHORIZED RMA WILL BE REFUSED AND RETURNED TO SHIPPER. All rush/advanced parts and component assemblies will accompany an invoice for SRP. The client MUST return replaced part/component assembly within 15 days of receipt; MDKS technicians will evaluate to determine the cause of defect or failure, and report findings within 15 days. At which time the open invoice will either be canceled or pursued. Clients will be charged a minimum of $75 for an RMA conversation with an IT Tech. Additional charges may apply if it is determined that the issue is unrelated to MDKS’ responsibility is and/or not under warranty, and the solution requires additional assistance.

Delivery & Shipping
*  Normal Delivery: 6-10 Weeks  (Actual delivery will vary depending on details of each specific & individual order.) 
*  Units will be Shipped Completely Assembled unless previously agreed upon.
*  Packaging: Suitable Bubble Wrap on a Pallet or Crated With Bubble Wrap as warranted.
*  Prices are USD and do not include shipping or applicable taxes.
*  FOB:  Cleveland, GA    Customer ownership begins at the time of FOB, and the client is responsible for any damage during shipping and insurance claims.  MDKS will thoroughly document  & record shipments prior to pick up.

*  The shipping & handling price on the quote & invoice reflects a calculated estimate by our freight vendors at the time of the quote.  The final shipping price may be updated at the time of shipping.  The differential will be the responsibility of the receiving party, and MDKS reserves the right to send an adjusted final invoice for those overages after the delivery.

Payments, Cancellation &/or Changes:
*Deposits are required to begin the build and the balance, plus shipping, is due when the unit is complete and ready to ship.  *50% deposit is required for units with SPWG panels 22” & smaller, & 65% for LPWG units 32” & greater.
*Signage of this quote &/or payment on the invoice reflects the acceptance of all MDKS/FITHco Inc.'s terms & conditions on the final proposed quote.
*Payment is due at receipt of invoice. Current interest charges will be applied monthly after 30 days.
*ORDER IS NON-CANCELLABLE AND NON-REFUNDABLE
*All kiosk and digital signage orders are unique and as such we have implemented a NO RETURN POLICY.
* Any changes after the original order has been processed may change the final price & the completion dates.

Return Policy:  Applies to all Hardware Purchases
All Touch Screen Equipment is unique to each order. We have implemented a NO RETURN POLICY due to the uniqueness of each order. We can work with each case by case and attempt to resell the unit for the purchaser. A restocking fee and an equipment evaluation fee will apply, this fee is 45% of the sale price. MDKS maintains the right to make this decision per case.  Please understand that MDKS DOES NOT rent kiosks.
